Race & Event Terms & Conditions
(The following terms and conditions apply to all Run Rugged Events. However, additional terms and conditions may be attached to specific events. Check individual race terms and conditions during the booking process)
By registering for any Run Rugged Event (the “Event”) organized by Run Rugged Events, you agree to the following Terms and Conditions. These terms form a legally binding contract between you (the “Participant”) and Run Rugged Events under Scots law. Please read them carefully before registering.
1. Eligibility and Registration
1.1 Eligibility: Participants must meet the minimum age requirement for the Event, as specified in the event details. If permitted by the event, participants under 16 (the age of legal capacity in Scotland under the Age of Legal Capacity (Scotland) Act 1991) must provide written consent from a parent or legal guardian.
1.2 Registration: Entry to the Event is confirmed only upon successful registration and payment of the entry fee through the official Run Rugged Events registration platform. Incomplete or unpaid registrations will not be accepted.
1.3 Accuracy of Information: Participants must provide accurate personal, medical, and emergency contact information during registration. Run Rugged Events is not responsible for issues arising from incorrect information.
1.4 Event Rules: Participants must comply with all Event rules, including but not limited to safety instructions, course regulations, and equipment requirements, as communicated by Run Rugged Events or its representatives. Failure to comply may result in disqualification without refund.
2. Acknowledgment of Risks
2.1 Inherent Risks: The Event involves physically demanding running or sport-based activities, which may take place on uneven terrain, in remote areas, or under adverse weather conditions. Participants acknowledge the inherent risks, including but not limited to physical injury, illness, disability, or, in extreme cases, death. These risks may arise from:
Strenuous physical exertion;
Challenging terrain (e.g., trails, hills, mud, water obstacles);
Weather conditions (e.g., rain, wind, extreme temperatures);
Limited or delayed access to emergency services in remote locations;
Contact with other participants or obstacles.
2.2 Participant Responsibility: Participants confirm they are physically fit and have adequately prepared for the Event. Participants with medical conditions must consult a General Medical Council (GMC)-registered doctor and disclose relevant details in the Medical Information Questionnaire.
2.3 Medical Clearance: For certain events (e.g., ultra-marathons), Run Rugged Events may require a sports medical certificate signed by a GMC-registered doctor to confirm fitness to participate. Participants will be notified of this requirement during registration.
3. Refund and Cancellation Policy
3.1 Participant Cancellations: Refunds for cancellations are subject to the following conditions, in line with the Consumer Rights Act 2015:
More than 8 weeks before the Event: Full refund, less 15% administration fee.
8 to 6 weeks before the Event: 50% refund
6 to 4 weeks before the Event: 25% refund
Within 4 weeks of the Event: No refunds will be issued.
3.2 Substitution Policy:
Participants may transfer their entry to another individual (a “Substitute”) up to [Insert Deadline, e.g., 2 weeks before the Event], provided:
The Participant notifies Run Rugged Events in writing at contact@runrugged.co.uk.
The Substitute meets all eligibility requirements and completes the registration process, including signing the Medical Information Questionnaire and Liability Waiver.
The Participant is solely responsible for finding a Substitute and arranging any financial transactions with them. Run Rugged Events will not facilitate or mediate substitutions.
A £5 administration fee may be charged for processing substitutions.
3.3 Event Cancellation or Postponement: If Run Rugged Events cancels or postpones the Event due to circumstances beyond its control (e.g., extreme weather, force majeure, government restrictions), participants will be offered:
A transfer of their entry to a rescheduled event date (if available); or
A partial refund, subject to deductions for non-recoverable costs (e.g., permits, equipment hire), as permitted by the Consumer Rights Act 2015. 3.4 Non-Refundable Costs: Entry fees are non-refundable except as outlined above. No refunds will be issued for failure to attend, failure to meet eligibility requirements, or disqualification due to non-compliance with Event rules.
4. Health and Safety
4.1 Medical Cover: Run Rugged Events will provide medical cover in accordance with Scottish Athletics and RunBritain guidelines, including first aid posts, paramedics, and access to emergency services where feasible. Participants acknowledge that remote locations may delay emergency response times, and Run Rugged Events will not be liable for delays except where caused by negligence, as per Scots law of delict.
4.2 Participant Responsibilities: Participants must:
Follow all safety instructions provided by Event staff or officials.
Wear appropriate footwear and clothing suitable for the terrain and weather conditions.
Carry mandatory equipment (e.g., hydration packs, maps, or headtorches) as specified in the Event details.
Report any injuries or medical emergencies to Event staff immediately.
4.3 Withdrawal: If a Participant withdraws during the Event, they must notify an Event official at the nearest checkpoint. Run Rugged Events is not responsible for transporting withdrawn Participants unless explicitly stated.
5. Data Protection
5.1 Personal Data: Run Rugged Events will collect and process personal and medical information in accordance with the Data Protection Act 2018 and UK GDPR. This data will be used for Event administration, safety, and emergency purposes only.
5.2 Sharing Data: Medical information may be shared with authorised medical personnel in case of an emergency. Personal data will not be shared with third parties except as required by law or for Event-related purposes (e.g., timing services).
5.3 Rights: Participants have the right to access, rectify, or request deletion of their data after the Event, subject to legal retention requirements under Scots law. Contact contact@runrugged.co.uk for further details or to exercise these rights.
6. Media and Publicity
6.1 Photo and Video Consent: By participating, you consent to Run Rugged Events capturing and using photographs, videos, or other media of you during the Event for promotional purposes (e.g., website, social media, marketing materials) without compensation. Media will be processed in accordance with UK GDPR.
7. Liability
7.1 Limitation of Liability: To the extent permitted by Scots law, including the Consumer Rights Act 2015 and Unfair Contract Terms Act 1977, Run Rugged Events, its staff, volunteers, sponsors, and affiliates shall not be liable for any loss, damage, injury, illness, or death arising from participation in the Event, except where caused by negligence, breach of statutory duty, or other matters where liability cannot be excluded under Scots law of delict.
7.2 Property: Run Rugged Events is not responsible for loss or damage to Participants’ personal property during the Event, except where caused by negligence.
8. Event Changes or Termination
8.1 Modifications: Run Rugged Events reserves the right to modify the Event format, course, or schedule due to unforeseen circumstances (e.g., weather, safety concerns). Participants will be notified as soon as practicable.
8.2 Termination: Run Rugged Events may terminate the Event during its course if conditions pose a significant risk to Participants’ safety. No refunds will be issued in such cases unless otherwise determined by Run Rugged Events, subject to the Consumer Rights Act 2015.
9. Governing Law and Jurisdiction
9.1 These Terms and Conditions are governed by Scots law. Any disputes arising from these terms or the Event shall be subject to the non-exclusive jurisdiction of the Scottish courts.
10. Acknowledgment and Acceptance
10.1 By registering for the Event, you confirm that you have read, understood, and agree to these Terms and Conditions. You acknowledge that you are not relying on any statements or representations by any person or entity as an inducement to participate, other than those expressly stated herein.
10.2 Severability: If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court or competent authority, that provision shall be deemed deleted to the extent required, and the remaining provisions shall remain in full force and effect.
10.3 Contract Formation: These Terms and Conditions constitute a unilateral contract under Scots law, accepted by the Participant upon registration and payment of the entry fee.
